The First Fulton Church recently made headlines by hiring Kellen Rollins, an openly gay pastor at its church. This represents the first such occurrence in the region. In response to Rollins hiring many members left the church. Soon they begin protesting every Sunday on the sidewalk in front of the church and in the church parking lot. The leader of the protest, Michael Huffman, stated publicly that a homosexual pastor was against the established values of the First Fulton Church and they would protest until a change was made. For several weeks Pastor Rollins asked the protesters to come inside and join the Sunday morning service. When that failed the church asked them to leave. Huffman and the protesters refused. The church called Chief Booth and asked him to remove the protesters from their property. The protesters countered, however, that the sidewalk in front of the church and its parking lot were, in fact, public lands. History showed that the land on which the First Fulton Church resided had been given to it by the city in 1812. Huffman also argued that because the church paid no property taxes, it did not enjoy full private property rights. Finally, the protesters argued that removing them would be in violation of the First Amendment, specifically its protections of free speech, freedom of association, and freedom of assembly.
