For this Application Assignment, consider the differences between measurement and observation. Then think about the differences between and among nominal, ordinal, interval, and ratio levels of measurement and why it is important to know the level(s) of measurement in a study. Finally, consider how you might improve the validity and reliability of variable conceptualization and measurement.
The assignment (2–3 pages): • Explain differences between measurement and observation. • Explain differences between the four levels of measurement: nominal, ordinal, interval, and ratio. • Explain why it is important to know the level(s) of measurement for variables in a study. • Describe two techniques that may be used to improve the validity and reliability of variable measurement. Support your Application Assignment with specific references to all resources used in its preparation. You are to provide a reference list for all resources, including those in the Learning Resources for this course.

Read the DMCA and do some research on both it and digital rights management (DRM) technology. Write an essay (750 to 1000 words) on the DMCA, DRM, and/or the (il)legality of DRM circumvention. Try to bring in supporting references from multiple sources. Thoughts to consider (though you can bring in whatever views you wish) include:
Under the “first sale doctrine”, if one purchases a work, one can resell it. If one has purchased the work, can one not do as one pleases with it?
Is circumventing DRM on a file one has legally purchased a “fair use”?
If all books in the future are protected by DRM, what would be the effect on educational fair use? Is this right? Is this wrong?

Value of Physical Evidence
Now that you have learned about some types of physical evidence that can be discovered at a crime scene, consider the value of this evidence. Should a prosecutor be able to gain a conviction based solely on physical evidence found at the crime scene?
If you were a juror on a murder case that had no eyewitness, no video evidence, and no confession, is it conceivable that you could vote to convict based only on the evidence presented by crime scene and crime lab employees? Keeping this scenario in mind, answer the following:
If you could not convict based only on physical evidence, explain why. If you could convict, specify which types of physical evidence would be enough to secure your vote to convict and why.

Essay Week 5 - Software Patents
To be patented, an invention must be novel (new), useful, and not obvious to one skilled in the arts in question. Binary computer systems function in very limited ways and provide a fixed set of instructions by which all programs must operate. It is the view of many skilled in the art of computer science that binary computer programs are then inherently not novel, are inherently obvious, and are therefore not due patent protection. [See: Against Software Patents – below]
Unfortunately, USPTO patent examiners do not always have the time available or the background in “the art” to make a complete determination as to novelty or obviousness. As a result, bad patents get approved like Amazon.com’s “Method and system for placing a purchase order via a communications network”. This patent was overturned after being found to fail the patent tests for novelty and non-obviousness. The case originated when Amazon sued Barnes and Noble for “infringing” on their “one-click” ordering system. If this patent had stood, Amazon.com could have possibly claimed control over much of the world’s e-Commerce. [See: Patent 5,960,411 –below]
Do some reading and research to draft a well-written (750 to 1000 words) essay on the topic of software patents. Should we provide software protection? What limits should be imposed? Do the courts current provide protection in the US? Do the courts current provide protection in Europe? How can we strike a balance that promotes progress in the useful arts and sciences?

Begin by locating several peer-reviewed articles from the past 5 years that support the problem you wish to address in your dissertation. These articles may be ones previously gathered for your annotated bibliography assignment or additional resources you select after receiving feedback on your topic from your course mentor.
For this assignment, create a problem statement. Your problem must come from a critical issue that must be addressed, otherwise negative consequences will occur or continue. In most cases, scholarly citations within the past 5 years are required to support the problem you will investigate.
Follow the directions below for your respective program of study:
For EdD Students:
Articulate a concise problem statement. Include appropriate published or relevant primary sources to document the existence of a problem worthy of doctoral level research. Follow these steps:
Present the general issue grounded in the research literature that leads to the need for the study. Identify the specific problem you wish to address. The documented problem may be a practical problem or issue in the profession or study context without an acceptable solution. In defining the problem, a clear discrepancy must be drawn between what exists currently and what is desired. Although an applied study design does not necessarily require generalizability beyond the study site, worthy problems must be relevant and documented beyond any particular study site. To identify and articulate a problem, consider the potential negative consequences to the field or stakeholders if the proposed research is never conducted.
Support your assignment with at least five scholarly resources. In addition to these specified resources, other appropriate scholarly resources, including older articles, may be included.
Length: 1-2 pages, not including title and reference pages

For your Final Project, you develop a 12- to 15-page research design paper for a criminal justice issue of your choice. Your paper should include the following elements: • A description of the criminal justice issue you selected. • The research question you are examining and hypothesis(-es) you plan to test. • An explanation of whether you would use qualitative, quantitative, or mixed research methods. • A description of your data collection method—experiment, survey, use of available data, field research, or some combination of approaches—and why you would choose to use that method relative to others. Include strengths and weaknesses of the method you selected. • An explanation of the measurement and sampling methods you would use. • Conceptual definitions of the key variables you need to measure. • An explanation of how you would measure each variable. • A list of survey questions that you would need to ask (if you plan to conduct a survey). • A description of the target population you plan to sample (including size of the population and other demographic and socioeconomic conditions, if known) or whether you plan to use existing data. If you choose existing data, be sure to provide evidence of reliability and validity and a description of the sample, concepts, and measures used in the original study. Also identify any limitations of the existing data

Objectives:
To demonstrate an understanding of tort law. To demonstrate an understanding of the role of precedent in reaching legal decisions
Task:
Discuss the following problems. Your answers should be in paragraph form. Identify the relevant tort and apply the law to the fact situation. Reach a conclusion. If the tort is one of negligence, identify each of the steps of a negligence action and discuss whether those steps have been achieved.
Grading: Each problem is worth six (6) marks. An excellent answer will correctly identify and explain the law; apply the law to the fact situation and reach a reasonable conclusion. For problems 1 and 5 you should also refer to a relevant case, as identified in the textbook, and explain its relevance to the fact situation. The cases should be cited correctly. Your ideas should be expressed clearly and without serious errors of spelling/grammar.
1. Henry Jones is the sole shareholder of Happy Go Lucky Company (HGLC). Henry, needing a loan from his bank, went to his accountant, Bob Wallice, and asked him to prepare a financial statement of the company that Henry could give to the bank to get the loan. Unfortunately, Mr. Wallice included certain property that did not belong to the company, which increased its value. When Henry took the financial statement to the bank, the bank caught the error, but made Henry guarantee the loan. The bank then told Mr. Wallice, who forgot to correct the error in the financial statement. A few days later, Henry decided he needed to invest more money in his company and began negotiations with a business associate, Carol Hill. When Carol asked for the financial statement of the company, Henry told her she could get it from the bank or from his accountant. Carol decided to go to the bank, which gave her the financial statement with the error in it. Based on the financial statement, Carol invested $50 000.00 in the company, only to realize a month later the problem with the financial statement the bank had given to her. If Carol suffers a financial loss as a result, does she have cases against Henry, Bob Wallice or the bank? Explain.
2. Mary is employed in administration at George Brown College, where she is paid $3500.00 a month. The administrative staff have gone on strike and blocked access to the College buildings. Mary wants no part of the strike, so she decides that she will cross the picket line. As she does this, an employee named Ralph says, "Unless you want a black eye, lady, you better not cross the picket line." John, another employee, pushes Mary back. Unknown to Mary, there is a hole in the pavement, that is on College property, that the College has been aware of for quite some time, but has done nothing about, and as Mary falls back, her shoe catches in the hole and she falls down, breaking her leg and spraining her right arm. Identify and explain the tort actions which occurred and the damages to which Mary may be entitled.
3. Mr. and Mrs. Hampton went to a restaurant and ordered a roast duck dinner for two. When they began their dinners, they found that the duck was frozen in the middle. They ate what they could of the dinner but complained to the waiter. The waiter listened but merely gave them the bill for the entire cost of the dinner. Mr. Hampton put half of that amount on the table and began to leave. The waiter and the manager caught up to him before he reached the front door, and although they allowed Mrs. Hampton to leave, they restrained Mr. Hampton. Furthermore, the manager called the police, who, after listening to the waiter and Mr. Hampton explain just what happened, arrested Hampton and took him to jail. Mrs. Hampton bailed him out within three hours. Discuss any tort actions which Mr Hamptom may be able to bring. Assess the liklihood of success.
4. Following an account broadcast on the TV station the night before about a particular city councillor having been pulled over for drunk driving, Joe, a political cartoonist, drew a political cartoon of the councillor, obviously drunk and with his clothes in disarray, having difficulty walking down a straight line on the road with a sober police officer looking on. This was published the next day in the paper for which Joe works. The city councillor involved had disagreements with Joe in the past and intensely disliked him. It turned out that the story published on TV was an error, but the city councillor chose not to sue the TV reporter and the station; rather he sued Joe for defamation. What would Joe's best defence be? Indicate the likely outcome.
5. Explain the distinctions between an action in negligence and an action for breach of fiduciary duty. Your answer should include an explanation of when a fiduciary duty will arise.
