In the last few years, companies have begun initiating and implementing social media policies for their employees to follow. These policies range from encouraging employees to use social media for marketing purposes to restricting the use of social media for employees in order to ensure that they do not hurt the company image. As these policies become more widespread, both the Society for Human Resource Management and the National Labor Relations Board (NLRB) have become concerned about the limits on speech and activity that employers are imposing on their workers. Further, in some states, laws are being passed to protect employees and potential employees from being required to disclose social media passwords during job interviews or after hire. Finally, many ethical concerns are being raised about the use of social media as a method of doing quick, informal background checks on potential hires or current employees. For your Case Study this week, research the following questions and provide your findings in answers that are about 2-3 good paragraphs each. The NLRB has made findings regarding the use of employee posts on social media sites to discipline or terminate those employees. Typically, these cases occur when an employee posts negative information about his or her current employer or boss. Sometimes, these are public, and other times, the employer uses spies or fake "friending" to see the Facebook page of the employee. Find at least one case or article online regarding this topic, and briefly explain the facts of the case, and the determination of the NLRB as to whether the employee was properly or improperly disciplined or terminated as a result of his or her use of social media to complain about, criticize, or publicly bash his or her company or boss. Provide the citation to the article that you discover. (Use the term concerted activity in your query or search to help you find one of these cases.) (25 points) Do you agree with the decision of the NLRB or court in the case that you described in Question 1 above? Why or why not? (15 points) Assume that this case happened at a place where you have worked in the past, or where you work now (or want to work.) Give an example of how the decision in the case above could lead to better or worse employee relations in your company. (20 points) Would a social media policy be a good method to help prevent instances such as those found in the case? Support your answer. If a social media policy were to be put in place, list three things that should be included in any policy and why you would include them. (25 points) Here are several tips for successfully completing this Case Study. You should incorporate information from the textbook, lectures, and discussions to support your position. In other words, tell me more than just your opinion. Provide some relevant facts from the course material to support your position. Please use APA formatting in your papers this term (5 points). There is an APA handbook and tutorial links in the Syllabus. Our online librarians and Tutor Source are also good places for APA help. Or you can try the APA guide video in THElHUB. To ensure that your paper isn't flagged in Turnitin.com, do not copy and paste the questions or information used in your answers into your paper. Instead, set up headings for each section where you answer the questions and summarize the information you use in your answers, using good APA form. Save your file using your last name and week number (e.g., Smith Week3.docx). Submit your assignment. This Assignment is for a HR/Compensation course:
The purpose of this assignment is to help you better understand the impact Federal legislation has on the rewards programs of organizations. You will find a bill/resolution under consideration in the current Congress and analyze it for possible impact on the employer, employees and the economy in general.
Go to THOMAS – a service of the Library of Congress: http://thomas.loc.gov/.
Since the 116th Congress (1919-2020) has just started, not many bills have been introduced yet. Click on “Advanced Search.” Make certain that the boxes for the 115th and the 116th Congress are checked.
Under “Legislation Types” unclick “all Legislation.” Click on “H.R.” below “All House” and “S.” under “All Senate.” This will assure that your search only turns up bills that could be voted into law.
Under “Words and Phrases” enter in your search term(s). PICK ONE. Some suggestions include:
Fair pay Executive pay Equal pay Unemployment insurance Employee ownership Paid time off Employer sponsored health care Living wage Pay discrimination FLSA (Fair Labor Standards Act) Minimum wage FMLA (Family and Medical Leave Act) Employee health care Prevailing wage ERISA (Employee Retirement Income Security Act) Pensions COBRA (Consolidated Omnibus Budget Reconciliation Act) Health insurance portability Collective bargaining Card check Wage differentials
While all of these will turn up legislation relevant to compensation and benefits, most will also turn up legislation which is not relevant to C&B. Make sure you select something relevant. For example, if you enter and search on the word “compensation” the first bill you will get HR 303, which provides for disability compensation for retired members of the Armed Forces. This is not something which impacts a business organization.
Click on the bill/resolution number. Click on the tab labeled “Text.” A summary of the bill may also be available under the tab labeled “Summary.”.
Assignment Instructions–
In three to five pages summarize the key points of the bill/resolution that you think would impact organization pay/benefit programs. Summarize the bill (in your own words). Read the text of the bill when you do this: frequently the impact of the bill on organization pay systems is not clear from the summary provided by THOMAS. Describe the impact you think the bill/resolution, if enacted, would have on the organization and on its employees.
As an example, in a previous executive pay scandal, a law was passed which limited executive base pay to no more than $1 million. (An organization could pay more, but could not deduct the excess from its taxes as a business expense.) Employers could pay performance-based bonuses and give stock options, however, since (presumably) these payments would motivate executives to high performance and increased share prices (good for all employees, shareholders and the economy in general). Of course it also motivated executive to cut corners and behave unethically (and criminally) to simulate high performance and to drive up share prices. What unexpected consequences might the bill/resolution you study have?
You may want to go to the New York Times, Wall Street Journal, Washington Post, Roll Call, CQ Weekly and other sources to help with legislative consequences. If you do make sure you properly cite everything you use.

Topics and Questions We Can Help You To Answer: Paper Instructions:
This assignment consists of two sections: a marketing plan (Word document) and Marketing Budget (Excel document) Note: You must submit both sections as separate files for the completion of this assignment.
For the first 6 months your company is in business—to give you time to perfect your product and to learn from actual customers—you will start marketing and selling in your own community, a radius of 25 miles from where you live.
For most non-alcoholic beverages, marketing (as opposed to the actual product itself) is key to success. Cola drinks, for example, are fairly undifferentiated, as are many energy drinks, juices, bottled water, and the like. Companies producing these types of beverages differentiate themselves and attract market share through marketing and brand awareness—both of which are critical to success.
Section 1: Marketing Plan and Sales Strategy (MS Word or equivalent) Write the 3–5-page marketing plan and sales strategy section of your business plan in which you do the following:
1. Define your company’s target market. a. Analyze the types of consumers who will be drinking your beverage in demographic terms (i.e., age, education level, income, gender, ethnic group, etc.). Outline the demographic information for your company specified on the worksheet in the course text (p. 107 | Demographic Description). b. Support your analysis with actual data on the size of the demographic groups in your local community (nearby zip codes). o Hints: At American FactFinder (http://factfinder.census.gov), you will find demographic information on potential consumers in your area. If you are selling through other businesses (such as grocery stores), indicate the number of those businesses in your local area. You will find information about such businesses in your local area at County Business Patterns (http://www.census.gov/econ/cbp/). Check Chapter 2 of Successful Business Plan for more research sources.
2. Assess your company’s market competition. a. Use the factors listed in the course text graphic (p. 123 | Assess the Competition) to assess your company’s market competition. b. Defend your plan to differentiate yourself from the competition using the information detailed on the worksheet in the text (p. 131 | Market Share Distribution). o Hints: Every business faces competition, and the non-alcoholic beverage market is an especially crowded market. o Hints: For example, in the soft drink market, it is intimidating to try to compete against Coke and Pepsi. Newcomers in mature markets typically must pursue niche markets or even create new market categories, as Red Bull did with energy drinks.
3. Clarify your company’s message using the information provided on the worksheet in the text (p. 160 | The Five F’s). Create a marketing slogan/tagline for your product. • o Hints: Before you choose your marketing vehicles, you must determine the message you want to convey through those vehicles.
4. Identify the marketing vehicles you plan to use to build your company’s brand. Justify the key reasons why they will be effective. o Hints: If you plan to use online marketing tactics, refer to the worksheet in the text (p. 171 | Online Marketing Tactics) to aid your response. Remember that even if you’re selling through grocery stores, you need to build your brand and social media is a major part of that in regard to beverages. Some of the marketing tactics that beverage companies use include sampling in grocery stores, building a following on social media, sponsoring events, and exhibiting at trade shows attended by retailers. You will use a combination of these tactics. For example, if you decide to give out samples in grocery stores, promote your sampling on your social media networks and those of the grocery store. o Hints: If you are planning to distribute through resellers, describe how you plan to reach them, for example, through industry trade shows or by establishing your own sales force. For information on trade shows, visit the Trade Show News Network (http://www.tsnn.com). You can exhibit or network at these shows.
5. Format your assignment according to these formatting requirements: a. Cite the resources you have used to complete the exercise. Note: There is no minimum requirement for the number of resources used in the exercise. b. The paper must be typed, double-spaced, using Times New Roman font (size 12), with 1-inch margins on all sides; references must follow APA format. Check with your professor for any additional instructions. c. Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required page length.
Section 2 uses the “Business Plan Financials” MS Excel template (see: Required Course Files in Week 1). Use the Business Plan Financials Guide (see: Required Course Files in Week 1) to support your development of the marketing budget.
6. Complete the “Marketing Budget” worksheet for your company. Note: Complete the Setup tab first based on the instructions located in the Business Plan Financials Guide (document you also downloaded from PlanningShop). Only the setup tab and marketing tab should be completed for this assignment. • • § Hints: The goal of the marketing budget is to help you determine how much it will cost you to reach your market and achieve your sales goals. § Hints: When filling out the “Marketing Budget” worksheet in the Excel spreadsheet, do the following: § Begin in the current year and complete a marketing budget for the first year of your business. The information you enter in the marketing budget spreadsheet will flow through to your “Income Statement” in the “Business Plan Financials.” § Leave the number at zero (0) for any marketing vehicles you do not intend to use. § Remember that all marketing activities involve costs. If social media represents a significant portion of your marketing, assume you will incur costs of advertising and these should be reflected on your budget. Even if a social media site charges nothing to use it, you will need to use company resources to manage the site, pay someone to execute your social media marketing campaigns, and most likely pay for ads on that site. § Do not leave the “Marketing Budget” blank assuming you will not have any marketing costs. § Do not complete all the rows; only fill in the costs for the marketing vehicles you will actually use. These must match the content you describe in Question 4 Word portion of this assignment.

Then, find another company with a problem they need to fix. You may use NASA, BP, or United Airlines, all of whom have had numerous high profile problems to solve in recent years, if you wish. Or, you may choose a company that you know has an issue. If you are unsure who to use, try searching "Companies with customer service problems" online and you will get a lot of ideas, though your problem doesn't have to be about customer service.
Write an APA-formatted paper that does the following: 1.Summarize the problem you researched. Then, apply Kallet's critical thinking framework to describe how the leadership of this company should think through the problem to create a solution. Finally, give at least one evidence-based solution—either that you came up with through your research or that you read the company is going to employ or did employ. Next, describe what VUCA considerations the leadership must keep in mind as they implement this solution. 2.Work on being concise but thorough, keeping your academically formatted paper to no more than 4 double-spaced pages. 3.Your paper should include, and be organized, as follows: ◦Introduction: Write an introduction that tells the reader what to expect of this paper (1 paragraph). It would be most effective to include a brief mention that leaders at Panera bread effectively used an understanding of critical thinking and VUCA to solve their "mosh pit" problem, and that this paper applies a similar framework to solving whatever problem in the organization that you chose. Choose an organization with a problem that you can research. ◦Problem: Describe the problem that you will be solving for another company, describing the situation (1–3 paragraphs). ◦Thinking Critically: Apply the framework for critical thinking as outlined by Michael Kallet in Think Smarter to the problem you identified to describe an evidence-based recommendation for this company to improve. You can create your own unique recommendation, or show how critical thinking applied to a solution that someone else came up with already or applied, which you read about in your research. (1–3 paragraphs) ◦Applying VUCA: Explain how VUCA (volatility, uncertainty, complexity, and ambiguity) could affect both the situation and your recommendation, and any important considerations for management in implementing the recommended solution (1–2 paragraphs). ◦Conclusion: Write a conclusion that wraps up and summarizes your document (1 paragraph).
